Terms of Service
Please read these terms carefully before using ORIGEN.
1. Acceptance of Terms
By accessing and using ORIGEN (the "Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.
2. Service Description
ORIGEN is a platform for purchasing unique, algorithmically generated art prints. Each artwork is created through generative algorithms and produced as a one-of-one physical print.
Key Features
- Each generated variation is unique and can only be purchased once
- Prints are produced on-demand through our fulfillment partner, Prodigi
- All prints include a certificate of authenticity
- Once you select and purchase a design, that exact variation is permanently locked to your order
3. Intellectual Property & Ownership
What You Own
When you purchase a print from ORIGEN, you own:
- The physical print itself
- The right to display the artwork privately
- The right to resell the physical print
What You Don't Own
Your purchase does not include:
- Copyright to the underlying algorithm or code
- Rights to reproduce, distribute, or create derivatives of the artwork
- Commercial usage rights (unless separately licensed)
- Digital reproduction rights
Artist Rights
The artist retains all intellectual property rights to the generative algorithm and code. The artist may continue to use the algorithm to create additional unique outputs.
4. Purchasing & Payment
Orders
All orders are subject to acceptance by ORIGEN. We reserve the right to refuse or cancel any order for any reason, including but not limited to:
- Pricing errors or technical issues
- Suspected fraudulent activity
- Violation of these Terms
- Unavailability of products
Pricing
All prices are in USD and include the cost of printing and framing (if selected). Prices do not include shipping costs, taxes, or customs duties, which will be calculated at checkout.
Payment
Payment is required at the time of order. We accept major credit cards and other payment methods as displayed at checkout. By providing payment information, you represent that you are authorized to use the payment method.
Design Lock
Once you complete your purchase, the specific generated design you selected is permanently locked to your order and cannot be purchased by anyone else. This ensures true uniqueness.
5. Production & Delivery
Production Time
Prints are custom-made to order. Production typically takes 5-7 business days, but may take up to 10 business days during peak periods.
Shipping
Shipping times vary by location (typically 3-15 business days after production). Please refer to our Shipping & Returns page for detailed information.
Delivery Issues
You are responsible for providing accurate shipping information. We are not liable for delays or non-delivery due to incorrect addresses provided by you.
6. Returns & Refunds
No Returns for Change of Mind
Because each print is uniquely generated and custom-made to order, we cannot accept returns for change of mind. Please carefully review your selected design before completing your purchase.
Damaged or Defective Items
If your print arrives damaged or defective:
- Contact us within 7 days of delivery
- Provide photos of the damage
- We will arrange a replacement or full refund
Cancellations
Orders may be cancelled within 24 hours of purchase for a full refund. Once production has begun, cancellations are not possible.
7. User Conduct
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer or copy any generative algorithms
- Scrape, data mine, or use automated systems to access the Service
- Interfere with or disrupt the Service
- Infringe upon the intellectual property rights of artists or ORIGEN
- Use purchased artworks for commercial purposes without separate licensing
8. Disclaimers & Limitations of Liability
Service "As Is"
The Service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
To the maximum extent permitted by law, ORIGEN shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
Color Accuracy
We make reasonable efforts to display accurate colors, but actual print colors may vary slightly from what appears on your screen due to monitor calibration and printing processes.
9. Dispute Resolution
Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration rather than in court, except that you may assert claims in small claims court if they qualify.
By agreeing to these Terms, you waive your right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
11. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
